Terms Of Business (Agent)
DEFINITIONS
Agent/You/Your – means The Company, partners or individuals authorised to transact business with us

We/Us/Our - means P J Hayman & Company Ltd. Stansted House, Rowlands Castle, Hampshire PO9 6DX.
INTRODUCTION
Your appointment as an Agent is conditional upon the acceptance of and adherence to the terms and conditions set out in this agreement.

Your appointment as an Agent provides you with the authority to issue Certificates of Insurance on our behalf.

Certificates of Insurance are prepared by us, acting on your instructions and then sent for you to sign and issue to your client as the appointed Agent.

In some cases and for certain products only, we will provide you with delegated authority to issue Certificates on our behalf by means of self-issue pads, pre-printed Certificates (requiring bordereau declaration) or via the Web.

As an appointed Agent you are authorised to sign and issue Certificates, for the range of products agreed, subject to the proper adherence of Insurance Practice and Underwriting Principles.

COMMISSION
Commission shall be paid in accordance with the Schedule (attached), but we may at any time revise or replace the commission schedule by notifying the agent in writing.

The Agent cannot charge any policy fee, service fee or any other fee or charge whatsoever unless that fee has been agreed by us and shown clearly on the Certificate of Insurance (unless the Agent has asked

for ‘net rates’ (in respect of Travel ‘Scheme’ business only) and is charging the client a separate fee for his services).

The Agent shall refund to us commissions on all cancelled insurances and return premiums at the same rate at which such commissions were originally allowed.

PREMIUM FINANCE CONTRACTS
The Agent shall not enter into premium finance agreements in our name.

If the Agent enters into a premium finance agreement in respect of coverage placed with us, the arrangements shall be solely in the name and entirely for the account of the Agent and we will not accept any responsibility for any such arrangement.

CERTIFICATE ISSUING
Where we issue certificates on behalf of the Agent, your instructions to incept cover MUST be received before the inception date. Cover cannot be back-dated. If the inception date is not specified then we will assume cover from the date of receipt of either the proposal form or your instructions, subject to the proposal form or instructions being satisfactory.

No refund of premium will be given if the Certificate is cancelled.

RENEWALS
We are not obliged to issue renewal notices in respect of annual certificates. However we do issue renewal notices for Commercial Travel Policies (such as Personal Accident, Business & Liability covers) and individual annual travel cover.

Renewal notices are sent on the basis that no claims have been reported, the age limit has not been exceeded and there is no change to the original underwriting information (particularly in relation to the health of the Insured Persons). If there is any doubt, then you should refer these cases to us.

When inviting renewal in all cases, it is essential that any material facts or alterations are disclosed.
